("EagleTrace," "we," "us," or "our"), the developer and operator of the Financial Service Center platform ("FSC" or "Platform"), accessible at this website and its subdomains.
By accessing or using the Platform - including by creating an account, submitting an application, or using any feature - you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Platform.
Financial Service Center is a technology platform developed and operated by EagleTrace, Inc. It serves as a marketplace and management portal that helps small business owners discover, apply for, and manage financial services - including merchant payment processing, business loans, business insurance information, and related financial tools.
EagleTrace, Inc. is a technology company, not a licensed bank, lender, payment processor, insurance company, broker, or registered investment advisor. EagleTrace acts solely as a technology intermediary and referral platform. All financial products and services accessible through the Platform are provided by independent, licensed third-party service providers ("Service Providers"). Your relationship with each Service Provider is governed by that provider's own terms, disclosures, and agreements, which you will enter into separately.
EagleTrace may receive compensation from Service Providers when users are referred to or apply for their products. This compensation does not affect the information presented on the Platform or the recommendations you receive.

By creating an account and using the Platform, you consent to conduct business electronically and to receive legally required notices and disclosures in electronic form, in accordance with the Electronic Signatures in Global and National Commerce Act (ESIGN Act) and the Uniform Electronic Transactions Act (UETA).
Your verified email address, combined with your explicit consent checkboxes and the recorded timestamp, IP address, and session information, constitutes your electronic signature ("E-Sign") for purposes of these Terms and any application or agreement you complete through the Platform.
You may withdraw consent to electronic records at any time via our contact form. Withdrawal may limit or terminate your ability to use the Platform. We retain records of all consents for the period required by applicable law.

When you submit applications for financial products through the Platform, you authorize EagleTrace and applicable Service Providers to obtain, use, and share information about your business and personal financial history for the purpose of evaluating your application. This may include credit inquiries and verification of business and personal information.
EagleTrace does not guarantee approval for any financial product. Approval decisions are made solely by Service Providers based on their own underwriting criteria and applicable regulations. EagleTrace is not liable for any Service Provider's decision to approve, deny, modify, or withdraw approval for any application.
Content on the Platform - including information about financial products, rates, fees, and terms - is provided for informational purposes only and does not constitute a commitment to lend, issue insurance coverage, or provide any specific financial product. All terms are subject to the Service Provider's final underwriting review.
The Platform offers an optional, free Business Credit Profile Scan service ("Credit Scan"). By opting into this service and checking the authorization checkbox, you expressly authorize EagleTrace, Inc. to submit your business information - including your legal business name, address, employer identification number (EIN), entity type, and self-reported credit information - to a third-party business credit screening service on your behalf.
No credit impact: The Credit Scan is an informational pre-screening only. It does not constitute a credit inquiry and will not appear on your personal or business credit report. It does not affect your personal or business credit score.
Results: EagleTrace will receive and display the screening results within your FSC Portal account. These results are sourced from third-party databases and are for informational purposes only. They do not constitute a credit decision, guarantee of loan approval, or representation regarding your actual creditworthiness.
Authorization scope: Your authorization covers a single scan submission. You may revoke this authorization at any time via our contact form. Revoking authorization does not affect scans already submitted.
Data accuracy: You are responsible for ensuring the business information you provide is accurate and complete. EagleTrace is not responsible for inaccurate scan results caused by incorrect or incomplete information you provide.
Nothing on the Platform constitutes financial, investment, legal, accounting, or tax advice. Information provided is for general informational purposes only. You should consult a qualified, licensed professional before making any financial, legal, or tax decisions. EagleTrace makes no representations or warranties regarding the accuracy, completeness, or suitability of any information on the Platform for your particular circumstances.
Certain Platform features require a paid subscription. Subscription fees are billed monthly in advance. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Cancellations take effect at the end of the current billing period. We do not offer refunds for partial billing periods.
We reserve the right to modify subscription pricing with 30 days' advance notice. Continued use of the Platform after a price change constitutes your acceptance of the new pricing.
The Platform and all content, features, and functionality - including text, graphics, logos, software, and data - are owned by EagleTrace, Inc. or its licensors and are protected by U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
Your use of the Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our collection, use, and sharing of your information as described in the Privacy Policy - including the sharing of your business and application information with Service Providers.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. EAGLETRACE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. EAGLETRACE IS NOT RESPONSIBLE FOR THE ACTS OR OMISSIONS OF ANY SERVICE PROVIDER.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EAGLETRACE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES - INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION - ARISING FROM YOUR USE OF THE PLATFORM OR ANY FINANCIAL PRODUCT OBTAINED THROUGH IT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless EagleTrace, Inc. and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the Platform, your violation of these Terms, or your violation of any applicable law.
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Platform shall first be subject to good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be submitted to binding individual arbitration under the rules of the American Arbitration Association, conducted in Orange County, California.
YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. Nothing herein prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.
We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination - including Sections 8, 11, 12, 13, 14, and 15 - will survive.
We may update these Terms at any time. We will notify you of material changes by posting the revised Terms on this page and updating the effective date. We will also send notice to your registered email address for material changes. Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.
